Guarantees

For California residential real estate transactions

At Prodigy, we put our promises in writing. These guarantees are designed for California buyers and sellers and are delivered through your standard representation agreements and escrow, not as side deals.

Important: Any “credit at closing” mentioned below is provided as a broker credit or commission reduction through escrow, fully disclosed on your closing statement and, if there’s a loan, subject to lender approval.*


1. Core Service Guarantees (Buyers & Sellers)

A. Communication Guarantee

We know “radio silence” is a top complaint about agents.

Our promise:

  • We return all calls, texts, and emails within 24 business hours, and

  • While your home is on the market or you’re actively shopping, we provide at least one proactive update per week about what’s happening and what’s next.

No fine print here—this is our baseline standard.


B. Availability / Showing Guarantee

For Sellers – Showing Guarantee

Our promise:

  • Every qualified showing request for your property will be accommodated within 24 hours whenever reasonably possible, taking into account occupant availability, security, and any HOA or tenant rules.

If we fail to reasonably accommodate a qualified showing request within that window due to something within our control, you’ll receive a $100 broker credit at closing on that listing.*

“Qualified showing request” means a request from a buyer or agent who is pre‑qualified, pre‑approved, or otherwise demonstrates reasonable financial ability and willingness to purchase at or near the asking range.

For Buyers – Tour Guarantee

Our promise:
For any available home you’re interested in, we will work to schedule a private tour within 48 hours whenever reasonably possible, subject to seller permission, access, and property rules.

“Available home” means an actively listed property that allows showings and is within Prodigy’s normal service area.


C. Listing Update Guarantee

Our promise to sellers:
Every week your home is on the market, you’ll receive a written update that includes:

  • Showing activity and feedback

  • Online activity/interest highlights

  • Our recommendations on price, presentation, or strategy

If a full week passes without a scheduled update from us while your listing is active, you’ll receive a $250 broker credit at closing on that transaction.*


D. Marketing Launch Guarantee

Our promise to sellers:
Within 5 business days of:

  1. Signing your listing agreement, and

  2. Completing professional photography (and any agreed prep),

your home will have:

  • An active MLS listing

  • Syndication to major real estate portals

  • A “Just Listed” digital campaign launched

If we miss this deadline for reasons within our control, we’ll discount our listing‑side commission by $50 at closing on that transaction.*

(Yes, $50 is small—we prefer to be conservative on the money and huge on the execution.)


E. Transparency / No‑Surprise Fees Guarantee

Our promise:

  • Every fee you may pay to us is disclosed and agreed to in writing before we list your home or write an offer on your behalf.

  • If any undisclosed Prodigy brokerage fee appears on your closing statement, we will pay or remove that fee ourselves, so you are not charged it.


2. Easy Exit & Performance Guarantees

A. Easy‑Exit Listing Guarantee

We don’t believe in holding unhappy clients hostage.

Our promise:
If you’re not happy with our service, you can cancel your listing with 24 hours’ written notice, with:

  • No cancellation fee from Prodigy, and

  • No hard feelings.

Exceptions:

  • Your home is already under contract, or

  • We have presented an offer that meets the written criteria you previously approved (price and terms).

Terms are documented in a signed addendum to the standard California listing agreement so everyone is clear.


B. On‑Time Support Guarantee

Sometimes delays happen—but they shouldn’t be because we blew a deadline.

Our promise:
If your closing is delayed by more than 7 days beyond the contract close date solely due to something our team failed to do (for example, missing a deadline we agreed to in writing), you’ll receive a $250 broker credit at closing on that transaction.*

This does not apply to delays caused by lenders, appraisers, inspectors, the other party, HOAs, title, escrow, or circumstances outside our control.


C. Service‑Backed Commission Guarantee

We are willing to put our commission on the line for our level of service.

Our promise to sellers:
If, during your listing period, we:

  • Fail to provide the promised weekly update,

  • Miss agreed‑upon marketing tasks (like launching the MLS listing or digital campaign within the agreed timeframe), or

  • Fail to respond within 24 business hours to your messages,

then you’ll receive a pre‑agreed reduction in our listing‑side commission at closing on that transaction.*

The exact amount (e.g., $___) will be filled in and agreed to in writing in your listing agreement so it’s clear and enforceable.


3. Buyer Confidence Program (12‑Month “List It Again”)

Buying a home is huge. We want you to feel confident.

Our promise to buyers:
If you’re not happy with the home we helped you buy, and within 12 months of your closing date you decide to sell it, we will:

List it for free on the listing side — our listing‑side commission is waived.

You will still be responsible for:

  • Buyer’s agent commission (if offered)

  • Normal closing costs, escrow, title, and any repair or concession costs

Key conditions (all spelled out in writing):

  • Primary residences only (no flips, second homes, or investment properties)

  • The property must be located within Prodigy’s normal service area and within an eligible price range

  • No major adverse condition changes caused by the owner (e.g., severe deferred maintenance, unpermitted structural changes, or damage)

  • You agree to list at a competitive price within our advised pricing range based on current market data

  • All mortgage, tax, and HOA obligations must be kept current up to the new listing date

The full terms appear in a short Buyer Confidence addendum to your buyer representation agreement.


4. Buyer‑Specific Guarantees

A. First‑Look / Priority Access Guarantee

Our promise:
You’ll be among the first to know about:

  • New listings that match your criteria

  • Select “coming soon” and off‑market opportunities where we are allowed to share details

We do this via daily MLS alerts, targeted searches, and agent‑to‑agent networking so you’re not the last to see a great home.

We always comply with local MLS rules and fair housing laws.


B. Education / Strategy Guarantee

You should never feel rushed into an offer.

Our promise:
Before you write an offer with us, you’ll receive:

  • A pricing and comps review so you understand value

  • An estimated net sheet or cost breakdown (closing costs and cash to close)

  • A basic negotiation plan (how we’ll try to position your offer and what your options are)

In other words: no “sign here and hope for the best.”


5. Seller‑Specific Guarantees

The Prodigy Peace‑of‑Mind Seller Guarantee

Every Prodigy seller automatically receives our 4‑Point Peace‑of‑Mind Guarantee, in writing:

  1. Communication Guarantee
    Fast response plus weekly updates while your home is listed.

  2. Marketing Launch Guarantee
    Your property is fully live and marketed within 5 business days of signing and completing photos, or you receive the agreed‑upon *listing‑side commission discount.

  3. Easy‑Exit Listing Guarantee
    Cancel with 24 hours’ written notice before you’re under contract—no cancellation fee, within the program rules.

  4. Feedback Guarantee
    For each showing, we will request and share feedback within 24 hours of receiving it from the showing agent, whenever it is provided.

    Where feedback is available and we fail to pass it along within a reasonable timeframe, we will address it under our Service‑Backed Commission Guarantee (Section 2C).

Every seller gets our 4‑Point Peace‑of‑Mind Guarantee in writing.
If we miss on any point covered by a monetary guarantee, you receive the applicable credit or commission reduction at closing,* as allowed by law and your lender.


6. California Terms & Conditions (Summary)

To keep everything clean and compliant in California:

  • Service‑based, not outcome‑based:
    These guarantees cover our service and processes, not market outcomes. We do not guarantee a specific sale price, days on market, appraisal value, loan approval, tax outcome, or future property value. California DRE advertising guidelines prohibit false, deceptive, or misleading ads, and require that any guarantees be truthful and supportable. California Department of Real Estate

  • How credits and discounts are delivered:
    Any dollar amounts mentioned as a “credit at closing” or commission reduction are implemented as:

    • A reduction in Prodigy’s compensation and/or

    • A broker credit through escrow, fully disclosed on the Closing Disclosure or settlement statement.
      California law allows brokers to rebate part of their commission to their own client if it is properly disclosed, routed through escrow, and not an illegal referral kickback. Ideal Realty+1

  • Lender approval when there is financing:
    In transactions with a loan, any broker credit may affect loan calculations and is typically treated like a closing‑cost credit. For that reason, all such credits are subject to lender approval; if a lender will not allow a credit as written, we’ll work in good faith with you, escrow, and the lender to apply the reduction in a compliant way.   • Disclosure & documentation:
    All guarantees are documented in writing (via addenda to your listing/buyer agreements and escrow instructions). DRE guidelines also require that real estate advertising be clear, truthful, and not “bait‑and‑switch,” and that any special offers or incentives have their restrictions disclosed before a consumer is obligated.   • DRE advertising & ID:
    On web pages and first‑point‑of‑contact materials where these guarantees are advertised, Prodigy will include the responsible broker’s name and California DRE license number in at least the minimum font size required by the Department of Real Estate’s advertising guidelines.   • Not legal or tax advice:
    These guarantees are a business and service program, not legal or tax advice. Clients should consult their own attorney, CPA, and lender for guidance on how credits, pricing, timing, and other terms may affect them.


* California Credit & Commission Reduction Note:

All monetary benefits described are offered solely as a reduction of Prodigy’s compensation or broker credit in connection with a transaction where Prodigy is a broker of record, are fully disclosed through escrow, and, when there is financing, are subject to lender approval and program rules. If a lender or program prohibits a particular credit structure, we will adjust the method of honoring the guarantee in a compliant way, but cannot override lender or investor requirements.
